- Truth in Advertising / Indemnification for Liability:
Advertiser is solely responsible for any legal liability arising out of or relating to (1) the Advertisement, and/or (2) any material to which users can link through the Advertisement. Advertiser represents and warrants that the Advertisement and Link comply with Kitelife.com's advertising standards; and that it holds the necessary rights to permit the use of the Advertisement and Link by Kitelife.com for the purpose of this Agreement; and that the use, reproduction, distribution, or transmission of the Advertisement will not violate any criminal laws or any rights of any third parties, including, but not limited to, such violations as infringement or misappropriation of any copyright, patent, trademark, trade secret, music, image, or other proprietary or property right, false advertising, unfair competition, defamation, invasion of privacy or rights of celebrity, violation of any anti discrimination law or regulation, or any other right of any person or entity.
Advertiser agrees to indemnify Kitelife.com and to hold Kitelife.com Management harmless from any and all liability, loss, damages, claims, or causes of action, including reasonable legal fees and expenses that may be incurred by Kitelife.com, arising out of or related to Advertiser's breach of any of the foregoing representations and warranties. Advertiser agrees to request that Kitelife.com be listed as an additional insured on any policy issued to Advertiser pursuant to which there could be coverage for any of the forms of legal liability described in this paragraph.
LIMITATION ON DAMAGES: IN NO EVENT WILL KITELIFE.COM BE LIABLE TO SPONSOR FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT KITELIFE.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
Your Obligation to Indemnify. You agree to indemnify, defend and hold Kitelife.com harmless from and against any third party claim, loss, liability, and expense (including damage awards, settlement amounts, and reasonable legal fees), brought against any Indemnified Person(s) (Kitelife), arising out of Your use of our advertising options, Your Web site, and/or Your breach of any term of this Agreement.
Kitelife.com will remove any ads that are reported to us as being scams. If one of the advertisements on our site is not providing what they are advertising to do so, please email us the details and we will remove the ad immediately.
You are NOT allowed to place ads to fraudulent sites, investment scams, or Ponzi Schemes. We reserve the right to decline any future publishing of the ads if people complain to us (no refunds given). We will remove any ads that direct to any site that is proven to be a scam. We are in no way affiliated with any of our advertisers and are not responsible for their actions.

- Use of Graphics / Banners / Text
Advertiser is 100% responsible for providing suitable graphics and text content for advertising on Kitelife.com, free of any copyright violation.
Advertiser may request custom graphics work for an additional fee.
Kitelife.com may only use Advertiser provided graphics within the function of Advertising with Kitelife.com, or with supplemental permissions provided by Advertiser.

- Downtime with Kitelife.com or Advertiser
By purchasing ads you agree to our Advertising Terms of Service, we are not responsible for any of your sites downtime. You rent a banner for a period of time, and if your site is offline during that time, you take the responsibility. We will not extend your advertising due to these circumstances.
In the event Kitelife.com experiences downtime and your ads are not displayed, we will freely refund a daily pro-rate against your lost advertising upon request.

- "Per Issue" Payment Schedule
"Per Issue" Advertising is due in the full amount absolutely no later than the first day of each even-numbered month (publish date).
Refunds are only possible for "Per Issue" Advertising in the instance of an automatic renewal (subscription) via PayPal, if refund is requested within 15 days of payment being processed.

- "Yearly" Advertising Agreement
Yearly specifies 12 months, annually renewing from Advertiser's start date (and first publish date) with Kitelife.com advertising.
In exchange for the discounted annual rate, Advertiser agrees to a commitment of four quarterly payments per year of advertising.
After four payments have been made, the yearly contract renews for another four payments annually, subject to cancellation by Advertiser within 15 days of first payment of each annual renewal date.
In the event of cancellation within first 15 days of a renewing year, full refund will be provided by Kitelife.com to Advertiser for the full amount of that first renewing (quarterly) payment.

- Payment Methods
Payments may be submitted via PayPal, Credit/Debit Card (through PayPal), Check or Money Order, made payable to Kitelife.

- Non-Payment / Payment Arrangements
In the event of delinquency or non-payment after 45 days without suitable and approved arrangements with Kitelife.com may result in complete and immediate removal of all paid Advertising throughout the Kitelife.com web site with no refund, pro-rated or otherwise.
Advertiser may contact Kitelife.com by phone or email to negotiate fair payment arrangements in times of difficulty, subject to approval by Kitelife.com management.
